1. Agreement and provider
These Terms are between the organization accepting them (“Customer”) and CompanyOS, Munzinger Str. 4, 79115 Freiburg, Germany (“CompanyOS”, “we”, or “us”). The person registering confirms that they can bind the Customer. Contact hemin.faraidun@gmail.com for service or contractual questions.
2. Service and trial
CompanyOS provides hosted business software for enabled modules such as organization, people, finance, sales, operations, communications, documents, and optional AI tools. New workspaces may receive a 14-day trial without a payment card. Trial limits and available features may change before a paid subscription begins.
3. Accounts and acceptable use
Customer must provide accurate details, protect credentials, assign access appropriately, and promptly remove users who no longer need access. Customer must not use the service to break the law, violate another person’s rights, distribute malicious code, probe another tenant, bypass limits, or make high-impact employment or financial decisions solely from automated output without appropriate human review.
4. Customer data and privacy
Customer retains its rights in Customer data and gives us the limited right to host, process, transmit, and back up that data to provide and secure the service. Customer is responsible for having a lawful basis and giving required notices to employees, applicants, customers, and other data subjects. Our Privacy Policy explains our processing.
5. Optional AI features
AI output can be incomplete or wrong and is not legal, tax, accounting, employment, or financial advice. Customer controls whether optional AI features are enabled and must review output before acting on it. Data sent to an enabled AI provider is also governed by that provider’s data-processing terms.
6. Fees and subscriptions
Paid subscriptions are billed using the price, currency, billing period, and seat count shown at checkout. Stripe processes payments. Unless the order says otherwise, subscriptions renew until cancelled through the available billing controls. Taxes are added where required. Overdue or ended subscriptions may become read-only or lose access.
7. Availability and changes
We work to keep the service available and secure but do not promise uninterrupted or error-free operation. We may change features to improve security, comply with law, or maintain the service. Material reductions to paid functionality will be communicated where reasonably possible.
8. Suspension and termination
We may suspend access for security threats, unlawful use, material breach, or non-payment. Customer may cancel its subscription and an authorized super administrator may request company deletion after exporting needed records. Legal retention duties may require some records to be restricted rather than immediately erased.
9. Warranties and liability
The service is provided with reasonable care and skill. To the maximum extent permitted by law, implied warranties are excluded. Neither party is liable for indirect or consequential loss. Any monetary liability cap, mandatory consumer protection, fraud, intent, personal injury, confidentiality, and data-protection liability is governed by the signed order and applicable law. This clause does not exclude liability that cannot legally be excluded.
10. Governing law and changes
These Terms are governed by the law of Germany, subject to mandatory law. We may issue a new version for material changes and request renewed acceptance. Continued use after the effective date constitutes acceptance only where applicable law permits.
